OVERVIEW

First Nations Bands

The Claims: This case alleges that the government of Canada has systematically split First Nations children from their bands, communities, families, cultures, languages, and religions. In so doing, Canada has breached First Nations bands’ rights to raise their own children and pass on their cultures, languages, and religions.

The Class: This is an opt-in class action, meaning that only First Nations bands that have agreed to participate are covered. All First Nations bands in Canada are invited to participate.

Our Partners: We are bringing this claim and parallel claims in other provinces with a consortium of firms across the country, including Cochrane Saxberg (Manitoba), Murphy Battista (BC), and Miller Titerle (BC).

The court will decide at a later date if the case will proceed as a class action.

Updates
  • August 28, 2023: The Federal Court set a timetable to decide the plaintiffs’ request that Canada deliver its statement of defence, which Canada has refused to do. The Court also ordered the parties to negotiate a timetable for the plaintiffs’ certification motion. The order is here.

  • August 21, 2023: The plaintiffs served their certification motion record on Canada.

  • July 18, 2023: The plaintiffs filed their Amended Statement of Claim.
  • January 31, 2023: We issued a Statement of Claim.
