Mackenzie Financial Corporation

This case alleges that Mackenzie Financial breached the privacy rights of Canadians whose highly sensitive and personal financial information was stolen by unknown cyber-criminals in a large scale cyberattack in January 2023. The case alleges that Mackenzie breached its fiduciary obligations to thousands of Canadians who had purchased mutual funds or mutual trust funds. The Mackenzie defendants have admitted that Mackenzie account numbers, names, addresses and SIN numbers had been exposed in a data breach.

This case further alleges that Mackenzie engaged a third-party company and transferred the personal information and data of its investors to Investor.com and that it failed to ensure that Investor.com’s security was adequate.

The case is proceeding as a class action on behalf of all persons in Canada whose information was hacked in the 2023 breach, resulting in the theft of personal information.
