Instacart Shoppers

May 16, 2023: This action was discontinued by the Ontario Superior Court of Justice. Details are set out in the Notice of Discontinuance. Please read the Notice as it may affect your legal rights.

Instacart is one of the world’s largest online grocery services.

This case alleges that Instacart breached employment laws by misclassifying full-service shoppers as independent contractors and failing to pay them for their minimum employment standards, including minimum wage, since 2015.

The court will decide at a late date if the case will proceed as a class action.

The case seeks to represent all current and former Instacart full-service shoppers in Canada who have performed shopping and delivery services for Instacart since July 2015.
