Lexpert recognized a case argued by the Sotos team as “Top 10 Business Decisions of 2021-2022”

Lexpert has released its Special Edition: Litigation 2022 and recognized Sotos team members Louis Sokolov and Jean-Marc Leclerc for their litigation and dispute resolution expertise. The team is featured for its successful representation of the plaintiff in Fresco v. Canadian Imperial Bank of Commerce, 2022 ONCA 115.

This is a ground-breaking overtime case on behalf of some 35,000 CIBC tellers and other customer service agents. Ontario’s Court of Appeal affirmed in February 2022 the Superior Court’s decision that CIBC’s overtime policies are illegal and unenforceable and that the Bank’s deficient record-keeping systems were institutional impediments preventing employees from being adequately compensated. This is one of the first cases to be certified as an overtime class action and is the first case to go to a merits decision.
